1. Who you are contracting with
FootyTrainy (the "Service") is provided by Joaquin Marcus ("we", "us", "our"), trading as FootyTrainy. These Terms govern your use of the Service.
2. Acceptance
By creating an account, purchasing a subscription or pack, or continuing to use the Service, you agree to these Terms. If you do not agree, please stop using the Service. You confirm you are of legal age to enter this agreement, or that you have authority to bind the organisation you represent.
3. The Service
FootyTrainy lets you build soccer training workouts from exercise blocks, save them, play them with a timed player, track your training history, and optionally purchase drill, template and sound packs or a Pro subscription that unlocks additional features.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose;
- commit fraud, send spam, or impersonate others;
- infringe anyone's intellectual property rights, including by uploading audio or other content you do not have the rights to use;
- interfere with the security or integrity of the Service — no malware, probing, penetration testing, scraping or automated bulk access;
- reverse engineer, resell, redistribute, or circumvent technical limits or paywalls.
6. User content
You keep ownership of the workouts, custom blocks and audio you add. For content submitted for cloud sync, you grant us a limited licence to host and process it solely to operate the Service for you. Uploaded audio is stored on your device and is not uploaded to our servers. If you believe content on the Service infringes your rights, contact us and we will review it and remove infringing material; repeat infringers lose access.
7. Intellectual property
We retain all rights in the Service, including its software, drill content, pack content, documentation and branding. Your purchase grants a limited, non-exclusive, non-transferable right to use the Service and any purchased content within your plan.
8. Payments, subscriptions and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, currency, tax, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Pro subscriptions renew automatically at the end of each billing period until cancelled. If you cancel, your Pro access continues until the end of the period you have paid for. 9. Health and safety disclaimer
FootyTrainy provides general fitness and training information. It is not medical advice. Consult a qualified professional before starting any training programme, and stop if you feel unwell. You train at your own risk.
10. Service level and warranties
We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential or special damages, including lost profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
12. Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
13. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination you can export your workout data on request for 30 days, after which it may be deleted.
14. Changes
We may update these Terms. Material changes will be posted on this page with a new "last updated" date; continued use means acceptance.
15. Governing law
These Terms are governed by the laws of the seller's place of residence, and the courts there have exclusive jurisdiction, unless mandatory local consumer law says otherwise.
